TERMS AND CONDITIONS

Welcome to PULSAR (“Pulsar,” “we,” “us,” “our”). These Terms & Conditions (“Terms”) govern your access to and use of drinkpulsar.com and any related sites, apps, and services (collectively, the “Site”), including purchases and subscriptions for PULSAR products (the “Products”). By using the Site, you agree to these Terms and to our Privacy Policy.

If you do not agree, do not use the Site.

1) Eligibility & Accounts
- You must be at least 18 (or the age of majority in your jurisdiction) to purchase.
- Information you provide must be accurate and kept current. You’re responsible for maintaining the confidentiality of your account and for all activity under it.

2) Purchases, Pricing & Payment
- Prices, promotions, and availability may change without notice. Taxes and shipping are calculated at checkout.
- We may refuse or cancel any order, including for errors, suspected fraud, or supply constraints. If we cancel after charging you, we’ll promptly refund the charge.
- Promo codes/credits can’t be sold or combined unless explicitly stated. Expired codes won’t be honored.

3) Subscriptions (Auto-Renewal)
- When you start a subscription, you authorize recurring charges to your chosen payment method at the stated interval until you cancel.
- Minimum commitment: Subscriptions can be paused or skipped at any time, but cancellation takes effect after your second shipment. After your second order is processed, you may cancel before the next renewal to stop further charges.
- We’ll show the next charge date in your account and email reminders when required by law. Update address, billing, or cadence in your account before the renewal deadline shown.
- We may update subscription pricing or terms with advance notice; you can cancel before changes take effect.

4) Shipping, Risk of Loss & Title
- We ship to the destinations shown at checkout. Delivery estimates are not guaranteed.
- Title and risk of loss pass to you upon delivery to the carrier. If an order is lost or arrives damaged, contact Support within 7 days—we’ll help file a carrier claim and make it right where appropriate.

5) Returns, Refunds & “Make-It-Right” Policy
- We want you happy—while keeping things fair.Satisfaction window (first purchase): If you’re not satisfied, contact us within 30 days of delivery. We’ll work with you on a replacement or refund per our policy.
- Unopened items: Unopened, resaleable items may be returned within 30 days of delivery with an RMA. Refunds exclude original shipping unless the return is due to our error.
- Defects/damage: Report within 7 days of delivery with photos; we’ll replace or refund.
- Exclusions: Heavily used/abused items, final-sale items, and bulk/wholesale orders are not eligible.
- Return process: Get an RMA from Support before sending anything back. We may provide a prepaid label or deduct return shipping from the refund depending on the reason.
- Refunds go to the original payment method after we receive/inspect the return (allow 5–10 business days for processing).
- Nothing here affects your non-waivable statutory rights.

6) Health & Safety; No Medical Advice
- Our Products are beverages and nutrition-adjacent goods, not drugs or medical devices. Content on the Site is for informational purposes only and isn’t medical advice. Consult a qualified professional about any questions, sensitivities, or conditions (e.g., caffeine sensitivity, pregnancy, medications).

7) HSA/FSAPULSAR is not pre-approved for HSA/FSA. Eligibility is plan-specific. If you intend to seek reimbursement, confirm requirements with your administrator (e.g., receipts, Letter of Medical Necessity). We can provide itemized receipts but do not provide medical advice.

8) Intellectual PropertyAll content on the Site—including text, logos, graphics, photos, videos, product names, and trade dress—is owned by or licensed to PULSAR and protected by law. You may not copy, modify, distribute, or use our content without written permission.

9) Acceptable UseDon’t misuse the Site. Prohibited behaviors include scraping, reverse engineering, introducing malware, interfering with service, or using the Site for unlawful purposes.

10) User Content (Reviews, Submissions)If you post reviews or send ideas, you grant PULSAR a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content in connection with the Site and our business. Don’t post anything unlawful, misleading, or infringing. We may moderate or remove content at our discretion.

11) Third-Party Services & LinksThird-party links or services are provided for convenience. We aren’t responsible for their content, policies, or practices. Use at your own risk.

12) DisclaimersTHE SITE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee specific outcomes or that the Site will be uninterrupted or error-free.

13) Limitation of LiabilityTO THE MAXIMUM EXTENT PERMITTED BY LAW, PULSAR AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE OR PRODUCTS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO PULSAR FOR THE PRODUCT(S) AT ISSUE IN THE SIX (6) MONTHS PRECEDING THE CLAIM OR (B) USD $100.

Some jurisdictions don’t allow certain exclusions/limitations; in those cases, the above applies to the fullest extent permitted.

14) IndemnificationYou agree to defend, indemnify, and hold harmless PULSAR from and against claims, damages, costs, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or misuse of the Site/Products.

15) Dispute Resolution; Arbitration; Class Waiver
- Informal resolution: Contact Support first; most issues can be resolved quickly.
- Binding arbitration: Any dispute that cannot be resolved informally will be resolved by binding arbitration on an individual basis under the rules of JAMS (or another agreed provider).
- No class actions: You waive the right to participate in a class or representative action.Opt-out: You may opt out of arbitration within 30 days of first acceptance of these Terms by emailing us at  with your full name and the statement “I opt out of arbitration.”
- Emergency relief: Either party may seek temporary injunctive relief in court to prevent misuse of IP or the Site.

‍16) Governing Law & Venue
- These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws rules.
- Subject to the arbitration clause, exclusive venue lies in the state or federal courts located in Delaware, and you consent to their jurisdiction.

17) Changes to Terms
- We may update these Terms from time to time. When we do, we’ll post the new date above. Continued use of the Site after changes means you accept the updated Terms.

18) Termination
We may suspend or terminate your access for any violation of these Terms or suspected fraud/abuse. You may stop using the Site at any time. Sections that by their nature should survive (e.g., IP, disclaimers, limitation of liability, dispute resolution) will survive termination.

19) Force MajeureWe aren’t liable for delays or failures due to events beyond our reasonable control (e.g., acts of God, supply chain disruptions, labor disputes, or carrier failures).

20) Communications & Marketing (Email/SMS)
By providing contact details, you consent to receive transactional messages (order/ship updates) and, if you opt in, marketing messages by email and/or SMS/MMS. Msg/data rates may apply. Opt out of marketing anytime (email unsubscribe; reply STOP for SMS). Transactional messages will still be sent.

21) Electronic Records & Signatures
You consent to receive records electronically and to sign electronically (E-SIGN). Checking a box, clicking “Agree,” or continuing to use the Site constitutes your signature.

22) Promotions, Trials & Credits
Promotions, trial offers, discounts, and credits are limited-time, non-transferable, and may include additional terms. Unless stated otherwise, they apply to future purchases only, cannot be stacked, and may be revoked for fraud, abuse, or error.

23) Gift Cards & Store Credit
Gift cards/store credit are not reloadable and not redeemable for cash (except where required by law). We aren’t responsible for loss or theft. Expirations and balances follow applicable law.

24) Pre-Orders & Backorders
Dates are estimates and may change. Unless stated otherwise, your card may be charged at order placement. If timing materially shifts, we’ll notify you; you may cancel before shipment for a full refund.

25) International Orders, Duties & TaxesFor shipments outside your country, you’re responsible for import duties, VAT/GST, and fees. Customs inspections can cause delays outside our control.

26) Allergens, Sensitivities & Use
Our products contain caffeine and other functional ingredients and aren’t suitable for everyone. Read labels and use as directed. Discontinue if adverse effects occur. If pregnant, nursing, under 18, or on medications, consult a qualified professional.

27) Product Information & Variations
We strive for accuracy, but packaging, materials, specs, and information may vary by batch. In a discrepancy, the product label/packaging controls.

28) Third-Party Marketplaces & Resale
Purchases from unauthorized sellers/marketplaces may be ineligible for returns, refunds, or support. We may refuse, limit, or cancel orders suspected of unauthorized resale.

29) Referral & Affiliate Programs
Participation in referral, influencer, or affiliate programs is subject to separate program terms. Participants must follow all disclosure rules (e.g., FTC guidelines) and platform policies.

30) Reviews & User Submissions
By submitting reviews or content, you grant PULSAR a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content. Don’t submit unlawful, infringing, or misleading material. We may moderate or remove submissions.

31) Electronic Payments; Chargebacks
You authorize us and our processors to charge your chosen payment method. If you dispute a charge, contact Support first; unauthorized chargebacks may result in account limits, collection of owed amounts, and termination of access.

32) Assignment
You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, reorganization, or asset transfer.

33) Severability
If any provision is found unenforceable, the remainder stays in effect, and the unenforceable term will be replaced with an enforceable one closest to the original intent.

34) Waiver
Our failure to enforce any right is not a waiver. Any waiver must be in a signed writing.

35) Entire Agreement
These Terms, plus any referenced policies (Privacy, Shipping, Returns, Subscription), form the entire agreement between you and PULSAR and supersede prior understandings related to the Site and Products.
